Bankruptcy:

PQ&F represents commercial and consumer creditors in Chapter 7, 11 and 13 cases, regularly appearing in all Bankruptcy Courts in the Eastern, Western and Middle Districts of Tennessee. PQ&F accepts Chapter 7 and 13 bankruptcy cases on a flat fee basis. Chapter 11 cases are generally only accepted on an hourly basis, but is subject to flat fee upon review of the documents and case specifics.

Our guaranteed turnaround time from receipt of your file until the filing of the first pleading is 48 hours. Last year we serviced over 1,300 new consumer bankruptcy cases.

Foreclosure:

PQ&F represents consumer and commercial creditors in foreclosure proceedings and conducts foreclosure sales in all counties in the State of Tennessee. Foreclosure services are provided on a flat fee basis, and PQ&F complies with all FNMA, FHA, FHLMC and VA caps with regard to foreclosure fees. 

Collections/Repossessions:

PQ&F collects consumer and commercial accounts across the State of Tennessee, generally on a contingent-fee basis. We are familiar with FDCPA, FCRA and the Tennessee Collection Services Act, and comply with all regulations in this regard. PQ&F handles and coordinates personal property repossessions in every county in the State of Tennessee. All consumer repossession work is performed on a flat-fee basis.

Civil and Commercial Litigation:

Our litigation practice represents clients in most major areas of the law and has extensive experience in all types of dispute resolution.  We represent clients in jury trials and appeals in federal, state and bankruptcy courts, as well as administrative tribunals and arbitration and alternative dispute forums throughout the United States. 

The substance of our litigation practice and experience includes a wide array of commercial matters ranging from banking and finance, employment, internet, administrative, corporate litigation, major products liability, aviation torts, real estate transactions and internal corporate investigations.

Our litigation section works with all other sections of the firm, including business reorganizations arising from complex matters in bankruptcy courts.

We work with our clients to minimize litigation risks on the front end and we are ready to assist when litigation is necessary.  PQ&F recognizes that not all our clients' cases need to be tried, but we are prepared to do so if necessary or desirable, and our clients' adversaries know we are so prepared.

Real Estate:

PQ&F is a full-service real estate law firm, performing commercial and residential real estate closings for local and national mortgage lenders, banks, brokers, buyers and sellers.  Each of our closings is conducted by attorneys. We offer additional disclosures as approved by our lender clients and simplified explanation of loan products.  
 
At PQ&F, we work hard to ensure your closing process is smooth, organized, complete and fully compliant, including compliance with regulatory bulletins published by the Tennessee's Department of Financial Institutions and Department of Commerce and Insurance.

Commercial Lending and Regulation:

PQ&F provides full service to commercial lending institutions.  Our attorneys are members of the ABA, Section of Business Law Commercial Financial Services Committee, the Association of Commercial Finance Attorneys and Ernest B. Williams III was the founder and first President of College of Commercial Finance Law.  We assist with all types of asset-based and non-asset based lending and handle loans and lease transactions under UCC Articles 9 and 2a, as well as real property loans.  W&P also focuses on loans secured by non-standard collateral, including aircraft and vessels.

PQ&F designs and customizes consumer finance programs to comply with Tennessee and federal laws, including e-based financial services.  We focus on the interplay between Tennessee and Federal Statutes, including Reg. Z, RESPA, Reg. M, and the Tennessee Consumer Protection Act.  We offer opinions and law charts concerning allowable finance charges and services charges for consumer transactions, including interest rate limitation, permissible loans charges, brokerage commissions, dealer incentives, etc.  Members of the firm serve on the Board of Governors of the Conference of Consumer Finance Law.

Consumer Regulatory:

PQ&F assists in licensing financial institutions under Tennessee Banking Laws as Residential Lenders, Thrift Companies, offerors of credit card services, etc.  We work with the Tennessee Department of Financial Institutions and participate on various task forces to monitor and revise Tennessee laws governing real and personal property consumer lenders.
